Terms of Service

By creating an account or using Bennkai Build (the "Service"), you agree to these Terms and our Privacy Policy. If you use the Service for a business, you confirm you can bind that business. You must be at least 18 years old.

Bennkai Build helps you visualize, refine and plan physical products using AI tools, including product and packaging visuals, draft drawings, spec sheets, cost estimates and sourcing research. Features available to you depend on your plan.

Keep your login secure and your details accurate. You are responsible for activity under your account. Tell us promptly at benjamin@bennkai.com if you suspect unauthorized access.

Paid memberships renew monthly until cancelled and are billed through Stripe at the price shown at checkout. You can upgrade or cancel at any time from your account. Refunds are covered in our Billing & Refunds Policy. We may change prices with at least 30 days' notice; changes apply from your next billing period.

You own the photos, ideas, text and files you upload, and, to the extent the law allows, the designs and outputs created for your projects. You give us a limited license to store, process and display your content only to run the Service for you. We do not use your private projects to market the Service or share them with other users. You confirm you have the rights to anything you upload and that your product does not infringe others' patents, trademarks, copyrights or designs.

AI output can be inaccurate, incomplete or similar to existing products. Visuals, drawings, specs, cost and margin estimates and factory research are planning drafts, not engineering certification, legal advice, safety or compliance approval, or quotes. Verify dimensions, materials, safety, regulatory requirements and intellectual property before manufacturing or selling. A supplement label or ingredient list is not a validated formula.

Sourcing results identify named companies found in public sources; these are not automatically verified, endorsed or guaranteed available. Supplier-provided listings and claims are labeled and reviewed before display. Any deal you make with a manufacturer, platform or other third party is between you and them. Bennkai Group services (design, branding, sourcing, production coordination, 3PL) are offered selectively under a separate written agreement and are not included in a membership.

A supplier may request to claim a real company; Bennkai reviews authority before granting access. A founder's explicitly sent quotation request and chosen contact details may be shared with its named supplier, but the founder's private project is not. A claimed supplier may answer its first real request for free. Paid supplier membership provides access to later eligible requests and additional company tools, not guaranteed leads, preferred placement, verification or orders. A supplier remains responsible for the truth of its company and product claims, quotes, certifications and replies. Bennkai does not take a percentage of transactions between founders and suppliers. The parties negotiate any transaction directly.

Do not use the Service to make illegal, unsafe, counterfeit or infringing products; to upload content you have no right to use; to harass anyone; to break, scrape, reverse-engineer or overload the Service; or to get around plan limits. We may suspend or close accounts that do.

Projects are private by default. Bennkai staff can view a project only if you invite them to it. See our Privacy Policy for details.

We may update the Service or these Terms; we will give notice of material changes by email or in the app. You may stop using the Service and cancel at any time. We may suspend or end access for breach of these Terms. Sections 5–7 and 11–13 survive termination.

The Service is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any product outcome, manufacturing result, sales or profit.

To the fullest extent allowed by law, Bennkai is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or $100 if greater. You agree to indemnify Bennkai against claims arising from your products, your content or your breach of these Terms.

Please contact us first so we can try to resolve any issue informally within 30 days. These Terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-law rules. Any dispute will be heard exclusively in the state or federal courts located in New Jersey, and you consent to their jurisdiction. Either party may bring qualifying claims in small-claims court.
